[TRANS] 110206 Japanese Media States "TVXQ Trio's Penalty For Breach Of Contract Is 130 Billion Won"

The Japanese media has made an analysis that TVXQ's penalty for breach of contract is at least 130 billion Won (approximately 117,600,000 USD).

On the 5th, Sankei Newspaper's Entertainment news site ZAKZAK analyzed the TVXQ crisis, in which Kim Junsu, Kim Jaejoong and Park Yoochun filed an exclusive contract suspension injunction against SM Entertainment in 2009 and are currently locked in a battle regarding the content of their contract.

In the report, a production representative who knows the entertainment management systems in both Korea and Japan well said, "During their Japanese activities, each member of TVXQ received 0.4~1% of the profits and they had a no guarantee clause in their contract that was put into action if they sold less than 50,000 copies of an album or single." He also revealed that, "If they commit a breach of contract, they have to pay compensations that are thrice the investments and twice the predicted profits that would have been made in the next six years. This means that their penalty for breach of contract would be around 10 billion Yen (approximately 136.4 billion Won)."

On this day, the team of ZAKZAK could not hide their amazement at the 'shocking' clauses of the contract as they stated, "All rights to the singers' appearance on any show, domestically and overseas, are given to the entertainment agency. The right to reproduce all materials composed and produced, copyrights, album rights, distribution rights, broadcasting rights, performance rights, and karaoke rights are all given to the agency."

At the end of the report, the team laid down a verdict that, "The Hallyu system invests a great sum of money, signs its singers on to long term contracts and slowly teaches and raises its rookies. Though this is a system not many Japanese people can comprehend, the Hallyu method is enabling its singers to top charts all over Asia."
